In order for you to feel safe when visiting our website, Delitraiteur is providing you hereinafter with detailed information regarding the processing of your personal data. The purpose of this privacy policy is to inform you on the ways we collect, use and transfer your personal data.

1. Data controllers

Delitraiteur S.A., established Chaussée de Namur, 59, 1400 Nivelles (Belgium), with the company number 440.017.239 is responsible for processing your personal data (data controller).
When you submit an application for a job in a Delitraiteur store, your application and the thereto attached documents are processed by the franchise store mentioned in the advertisement. This store is then responsible for processing this data used in the context of recruitment.
When you sign up to our My Fidelity loyalty programme, Delitraiteur is responsible for processing your personal data. In this context, however, Delitraiteur uses the MyFreedelity shared loyalty programme. When you register, you therefore also consent to the processing of your identification data by Freedelity S.A., established rue du Bosquet 8, bte 6, 1400 Nivelles (Belgium) in accordance with its privacy policy shared with you upon registering. You will find more detailed explanations in section 3 below.

2. How do we collect your data?

We collect personal information from our users in several ways:
• via application forms on our website for a job vacancy in one of our stores
or to become a franchisee
• via our My Fidelity loyalty programme in partnership with Freedelity S.A. –
you communicate your data either through the automatic input of your data when you swipe your identity card in a card reader, or manually. Your data may be collected through the MyFreedelity application, or in our Delitraiteur stores (at the checkout or possibly at a terminal)
• through our email address info@delitraiteur.be when you contact us directly
• via cookies on the website when you give your consent.

3. For which purposes do we collect your data and on which legal grounds?

APPLICATIONS FOR A JOB OR A FRANCHISE
Delitraiteur, and its franchise stores where applicable, process data from website forms (identification data, contact data, CV, interests, additional information) to respond to your application. Mandatory data fields are marked with an asterisk* in the form. Optional data can help us better understand your interests and your request.
Legal grounds: This data is processed as part of the performance of pre-contractual steps for a (possible) contract with Delitraiteur or one of its franchise stores.
Data retention: Delitraiteur and its franchise stores keep the data collected in this context for a period of 12 months.

OUR MY FIDELITY LOYALTY PROGRAMME
The Delitraiteur My Fidelity loyalty programme is based on the shared MyFreedelity programme of the company Freedelity S.A. With this programme, you register only once on the MyFreedelity application to then allow different brands (including your favourite Delitraiteur brand) to access this basic data for their specific loyalty programme.
You can either register for our loyalty programme in our stores (at the checkout, and at a terminal in certain points of sale), or on the MyFreedelity application by then joining the Delitraiteur programme.
When you register, your identification data (your last name, first name, sex and date of birth – online registration via the application also requires an email address and a password) are absolutely necessary for us to create your profile and give you your gift on your birthday. Other optional data (email address, mobile phone number, postal address, language) will allow us to offer you advantages better suited to your profile.
We also use other data under our loyalty programme in order to make sure that customers, the programme and the advantages granted are properly managed:
• We thus process your card creation date;
• When you have given us your consent to send you
personalised marketing communications -we process information relating to the sending of text messages, communications by post, and marketing emails, as well as the opening of emails;
• We also process your purchase data (products, date of purchase, store, amounts, etc.) to grant you advantages (points), give you access to your purchasing history and personalise our marketing communications when you have agreed to receive them.

Legal grounds:
Mandatory data is processed as part of the performance of the contract (registration to the loyalty programme to receive points and advantages at our points of sale).
Optional data is processed based on your consent. It allows us to offer you advantages by email, text messages or other channels, and to better suit them to your profile.
Your purchase data allows us to grant you loyalty points (processing for the performance of the contract), to give you access to the history of your purchases in our store (available on the application), and to personalise the communications that you agree to receive (processing based on our legitimate interest).
We also process all of our customers’ purchase data in a general manner for our legitimate interest in knowing the interests of our customers, adapting our offer, organising our stores, developing our network in certain regions, carrying out projective analyses and reporting.
Data retention:
Delitraiteur retains loyalty programme data for a maximum of 3 years after your card was last used in store or via the application. After this period, your data is anonymized unless Delitraiteur has a legal obligation to keep your data or if it is necessary in the context of the processing of a dispute.
Even if you stop participating in the Delitraiteur loyalty programme, be aware that Freedelity S.A. will continue to use your shared identification and contact data with other brands in accordance with the provisions of its privacy protection policy. You will find this policy in the MyFreedelity application (go to the “about and privacy” menu).
Editing your data:
You can edit your data at any time in the MyFreedelity app or ask your cashier to do so in store. You can unsubscribe online at any time.
SENDING OF MARKETING COMMUNICATIONS BY EMAIL, SMS OR OTHER CHANNELS
With your permission, Delitraiteur sends you information and advantages related to Delitraiteur’s
actions and/or products, including exclusive offers. You can choose to have these personalised communications of a commercial nature sent to you by email, text message (SMS) or post.
Legal grounds: Marketing communications are only sent to you if you have given your consent to receive them. You can give this consent in store when you sign up to our MyFidelity loyalty programme or online in the MyFreedelity application (go to the section assigned to Delitraiteur).
Withdrawing your consent: You may change your mind at any time by modifying your communication preferences on the MyFreedelity application or by telling your cashier in a Delitraiteur store. You can also unsubscribe from our marketing communications by email using the unsubscribe link included at the end of each email.
Personalisation:
Delitraiteur personalises its communications to ensure that you receive the most interesting information for you. Delitraiteur analyses your purchase data collected whenever you check out using your loyalty card.

CONTACTS
Your data is processed by the employees of Delitraiteur or our franchise stores when you contact us by email. We will use it to answer your question or follow up on your request.

COOKIES
Delitraiteur uses cookies, pixels and other similar devices to personalise its website and track its use.

Legal grounds:
Cookies that are not essential for the operation of the website are only placed on your computer if you have given us your consent to do so. Necessary and functional cookies which are used to make the website work or which make it appear according to your wishes (for example in the language of your choice) must be stored on your device.

4. Who do we share your data with?

Our franchise stores
If necessary for the purposes for which the personal data is processed, we may communicate your personal data to our franchise stores. They will use your data for the same purposes as those explained in this Policy.
Our technical service providers (subcontractors)
We use service providers to process your data within the framework of specific services that we have set up, or in order to send information concerning products and services. We guarantee that these service providers only have access to your data insofar as this is necessary to perform their tasks. We also guarantee that they are bound by a confidentiality obligation and that they never use your personal data for their own purposes.
You will find below the list of categories of subcontractors who act in the name and on behalf of Delitraiteur:
• Marketing agencies which help us plan marketing campaigns, promotional actions, or manage our social media pages
• Analysts who help us analyse buying behaviour and determine customer preferences
• Agencies which help us answer your questions (for example, over social networks)
• Database managers (who manage the data, ensure it is updated, and maintain its quality level)
• Suppliers of IT systems and applications that are used in our stores
• External consultants
• Freedelity S.A. which processes your personal data on behalf of Delitraiteur
as part of our My FideliIty loyalty programme
• Intermediate subcontractors who send you operational and marketing information by e-mail, SMS,
post or other channels on behalf of Delitraiteur

• Companies specialised in conducting satisfaction surveys.
Compulsory data transfers
On occasion, we may be required to transfer your personal data at the request of public or judicial authorities, police forces or in application of the law.
We may also pass on your data to prevent physical or financial harm, or in the event of an investigation of suspected or proven fraud or illegal activities.
Third parties
If we share your data with a third party, other than a technical service provider or a mandatory recipient, we will never do so without your specific and prior consent.
Sale or transfer of our operations
We reserve the right to transfer all your personal data in our possession in the event of the sale or transfer of all or part of our operations or assets. The assignee will let you know how your data is being processed.

5.Your rights

Right to information and right of access
As a user of the website and our services, you have the right to request information as to which of your personal data we keep and the purpose for which it is processed. This information is provided in this document.
You also have the right to request access to your data.
Right to rectification, right to erasure
You have the right to demand that incorrect data be corrected and that data that is inappropriate or no longer needed be deleted. To correct your identification or contact data or change your marketing communication preferences (by email, SMS or by post), please do so via the MyFreedelity application or ask a member of our in-store team to edit your data.
Right to restriction of processing, right to data portability
You also have the right to ask us to restrict the processing of your data as well as the right to data portability.
Right to withdraw consent and right to object
You have the right to withdraw any consent you have given us at any time. The consent-based data processing carried out before consent was withdrawn will nevertheless remain valid.
If personal data is collected on the basis of our legitimate interest, you have the right at any time to object, on grounds relating to your particular situation, to the processing of this personal data. We will no longer process your personal data unless we demonstrate compelling legitimate interests justifying the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of our legal claims.
Right to lodge a complaint with a supervisory authority
If you feel wronged, you have the right to lodge a complaint with the competent supervisory authority. You will find information about the Belgian Data Protection Authority at www.autoriteprotectiondonnees.be.
However, do not hesitate to contact us first if you have a request regarding the processing of your personal data.

6. How can you exercise your rights?

To rectify your data, withdraw your consent to us sending you marketing communications or delete your account, please access the MyFreedelity app or contact the cashier in store. You can also unsubscribe from our marketing emails by clicking on the unsubscribe link that features in all the emails we send you.

7. Changes to this Policy

This Policy regarding the processing of your personal data (Privacy Policy) may be amended periodically to better reflect the way in which we process your data at Delitraiteur. We may not necessarily notify you in advance. However, any changes will be highlighted on our website. You will find the last modification date at the top of this page.
